Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of Coloring Magic ("we," "us," "our," or "the Service"), an online platform that allows users to generate custom coloring-book pages and PDF coloring books using artificial intelligence. By creating an account or using the Service, you agree to be bound by these Terms, our Privacy Policy, Content Policy, Acceptable Use Policy, and all other policies referenced herein (collectively, the "Agreement"). If you do not agree to any part of this Agreement, you must not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

In jurisdictions where the GDPR applies, if you are under 16 years of age, parental or guardian consent is required for the processing of your personal data (Article 8 GDPR). The Service is not directed at children under the age of 13, in compliance with the U.S. Children's Online Privacy Protection Act (COPPA).

3. Account Registration

To use the Service, you must create an account by signing in through one of our supported authentication providers (currently Google or GitHub). You are responsible for:

  • Maintaining the security of your account credentials and authentication tokens.
  • All activity that occurs under your account.
  • Notifying us immediately if you become aware of any unauthorised use of your account.

You may not share your account with others, create multiple accounts to circumvent restrictions, or use another person's account without their permission. We reserve the right to suspend or terminate accounts that we reasonably believe are being misused.

4. Description of the Service

Coloring Magic allows you to:

  • Enter text prompts describing coloring-book imagery you would like to create.
  • Generate AI-powered coloring-book page images based on those prompts.
  • Organise generated images into coloring-book projects.
  • Download your coloring books as printable PDF files.

All images are generated by third-party AI models (currently OpenAI). The Service is provided on an "as available" basis; we do not guarantee uninterrupted access, specific generation results, or that generated images will meet your expectations.

5. Tokens and Payments

5a. Token System

Image generation requires tokens. Tokens are purchased in packages through our payment system. Current token packages and pricing are displayed on our pricing page [TOKEN_PACKAGES_PLACEHOLDER]. Prices are in United States Dollars (USD) and are inclusive of the stated amount; applicable taxes may be added at checkout depending on your jurisdiction.

5b. Payment Processing

All payments are processed securely by Stripe, our third-party payment processor. By making a purchase, you agree to Stripe's terms of service. We do not store your credit-card details; all payment information is handled directly by Stripe.

5c. Token Validity

Tokens do not expire as long as your account remains active and in good standing. Tokens are non-transferable and may not be resold or exchanged for cash.

5d. Failed Generations

If an image generation fails due to a technical error on our side, the tokens consumed for that attempt will be automatically refunded to your account balance.

5e. Refunds

Token purchases are subject to our Refund and Cancellation Policy.

6. Consumer Right of Withdrawal (EU/EEA)

If you are a consumer in the European Union or European Economic Area, you have a 14-day right of withdrawal for online purchases under Directive 2011/83/EU (Consumer Rights Directive) and the Austrian Consumer Protection Act (KSchG).

However, because tokens are digital content that is delivered immediately upon purchase, you expressly consent to the immediate delivery of the digital content (tokens) and acknowledge that you thereby lose your right of withdrawal once the tokens are credited to your account, in accordance with Article 16(m) of the Consumer Rights Directive.

Before completing your purchase, you will be asked to confirm that you agree to immediate delivery and understand that this waives your right of withdrawal.

7. Intellectual Property

Intellectual-property rights related to prompts, generated images, and our platform are governed by our IP and Output Rights policy. In summary:

  • You retain rights in the prompts you submit.
  • You receive a broad, non-exclusive licence to use generated images for personal and commercial purposes, subject to the restrictions in our policies.
  • We retain all rights in the Coloring Magic platform, brand, and technology.
  • Generated images may not be copyrightable in all jurisdictions. We make no representation as to the copyright status of AI-generated outputs.

8. Prohibited Conduct

Your use of the Service is subject to our Content Policy and Acceptable Use Policy. In addition, you agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorised access to any part of the Service or its systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use automated tools, bots, or scripts to access the Service beyond normal use.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Resell, sublicence, or redistribute the Service or access to it.
  • Circumvent or attempt to circumvent our content-moderation or safety systems.

9. Disclaimers

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that generated images will be accurate, complete, unique, suitable for any particular purpose, or free from resemblance to existing works.
  • We do not warrant that the Service will be uninterrupted, error-free, or secure.
  • AI-generated outputs may contain unexpected results. You are responsible for reviewing and evaluating all outputs before use.

These disclaimers do not affect any rights you may have under mandatory consumer-protection laws that cannot be waived or limited by contract, including rights under the Austrian Consumer Protection Act (KSchG), EU consumer law, and the UK Consumer Rights Act 2015.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms shall not exceed the total amount you have paid to us in the twelve (12) months preceding the event giving rise to the liability.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under the laws of Austria, the EU, or your jurisdiction.

11. Indemnification

You agree to indemnify, defend, and hold harmless Coloring Magic and its operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms or any applicable law; (c) your use of generated images in a manner that infringes the rights of a third party; or (d) content you submit to the Service.

This indemnification obligation does not apply to the extent that the claim arises from our own negligence or wilful misconduct, or to the extent it is prohibited by applicable consumer-protection law.

12. Termination

12a. By You

You may close your account at any time by contacting us at support@coloringmagic.art. Closing your account does not entitle you to a refund for previously purchased tokens.

12b. By Us

We may suspend or terminate your account at any time if:

  • You breach these Terms or any of our policies.
  • We are required to do so by law or a court order.
  • Your account has been inactive for an extended period (we will provide advance notice).
  • We reasonably believe your account poses a risk to the Service or other users.

Where we terminate your account, we will provide you with a statement of reasons in accordance with the EU Digital Services Act, except where doing so would compromise an investigation or endanger safety.

12c. Effect of Termination

Upon termination, your right to access the Service ceases immediately. We will delete your account data in accordance with our Privacy Policy, except where retention is required by law. Any remaining token balance may be forfeited if termination results from a policy violation.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Austria, without regard to its conflict-of-laws principles.

If you are a consumer habitually resident in the European Union, you also enjoy the protection of any mandatory provisions of the consumer-protection laws of your country of residence that cannot be derogated from by agreement. Nothing in these Terms deprives you of the right to bring proceedings before the courts of your country of residence (Article 18 of Regulation (EU) No 1215/2012, the Brussels I bis Regulation).

If you are a consumer in the United Kingdom, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or limits your right to bring proceedings in your local courts.

14. Dispute Resolution

We encourage you to contact us first at support@coloringmagic.art to attempt to resolve any dispute informally.

In accordance with the Digital Services Act, you have the right to submit complaints through our internal complaint-handling system and, if not resolved, to refer the matter to a certified out-of-court dispute-settlement body in an EU member state.

For EU consumers, the European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We are not obligated and currently not willing to participate in dispute resolution proceedings before a consumer arbitration board, but we will evaluate participation on a case-by-case basis.

15. Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will notify you by posting a prominent notice on the Service and updating the "Last updated" date. Where required by law, we will provide at least 30 days' advance notice before changes take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and close your account.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

17. Entire Agreement

These Terms, together with the Privacy Policy, Content Policy, Acceptable Use Policy, IP and Output Rights, Cookie Policy, Refund and Cancellation Policy, and all other policies referenced herein, constitute the entire agreement between you and us regarding the Service.
