Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") defines how you may and may not use Coloring Magic ("we," "us," or "the Service"). It supplements our Terms of Service and Content Policy. Where this AUP and the Content Policy overlap, the more restrictive provision applies.

2. Permitted Uses

The Service is designed for generating printable coloring-book pages using AI. You may use the Service for:

  • Creating coloring-book pages for personal use, gifts, education, or entertainment.
  • Commercial use of generated images, such as selling printed coloring books, incorporating images into products, or using them in digital designs, subject to the restrictions in our IP and Output Rights policy.
  • Compiling generated pages into PDF coloring books for download and distribution.

3. Prohibited Uses

In addition to the content restrictions in our Content Policy, the following uses of the Service are prohibited:

3a. Circumventing Safety Systems

You may not attempt to bypass, disable, or circumvent our content-moderation filters, prompt-screening systems, AI model safety configurations, rate limits, or any other technical safeguard. This includes prompt injection, jailbreaking techniques, encoding prohibited content in non-obvious ways, or any other method designed to produce outputs that would otherwise be blocked.

3b. Automated and Excessive Access

You may not access the Service through automated tools, bots, scrapers, or scripts beyond what is necessary for normal human use. Specifically, you may not:

  • Send automated requests to generate images without human initiation.
  • Scrape, crawl, or spider our website or API endpoints.
  • Use the Service to build competing products or benchmark AI models.
  • Engage in bulk generation that is disproportionate to normal personal or commercial use.

3c. Account Misuse

  • Account sharing. You may not share your account credentials or allow others to use your account.
  • Multiple accounts. You may not create multiple accounts to circumvent usage limits, enforcement actions, or to gain unfair advantage.
  • Resale of access. You may not resell, sublicence, or redistribute access to the Service or to generated outputs on behalf of others using your account in a service-bureau capacity, unless separately agreed in writing.

3d. Reverse Engineering and Security Attacks

  • You may not reverse-engineer, decompile, disassemble, or otherwise attempt to extract the source code, algorithms, or underlying models of the Service.
  • You may not probe, scan, or test the vulnerability of the Service or any related system without prior written authorisation.
  • You may not launch denial-of-service (DoS or DDoS) attacks, inject malicious code, or attempt to gain unauthorised access to our systems, servers, or other users' accounts.

3e. Misrepresentation

  • You may not use the Service to generate content that impersonates another person, organisation, or entity.
  • You may not present AI-generated images as human-made in contexts where disclosure of AI origin is required by law, including under Article 50 of the EU AI Act.
  • You may not use generated images to create fake documents, credentials, or identification materials.

3f. Interference with the Service

You may not take any action that imposes an unreasonable or disproportionately large load on our infrastructure, interferes with the proper functioning of the Service, or degrades the experience of other users.

4. Fair Use and Rate Limits

We may implement rate limits, queuing, or other mechanisms to ensure fair and reliable access to the Service for all users. These limits are applied consistently and may vary based on account status and system capacity. Attempting to circumvent rate limits is a violation of this policy.

5. Monitoring and Enforcement

We monitor use of the Service to detect and prevent violations of this AUP. Monitoring may include automated analysis of prompts, review of usage patterns, and investigation of reports submitted by users or third parties.

Violations may result in graduated enforcement actions, proportionate to the severity and frequency of the violation:

  • Warning. A written notice describing the violation and requesting that you cease the prohibited activity.
  • Temporary restriction. Temporary limitation of your ability to generate images or access certain features.
  • Account suspension. Suspension of your account pending investigation or resolution.
  • Account termination. Permanent closure of your account for serious or repeated violations. Remaining token balances may be forfeited.
  • Law-enforcement referral. We will report illegal activity to competent authorities as required by law or where we reasonably believe it is necessary to prevent harm.

Where we take enforcement action, we will provide a statement of reasons in accordance with Article 17 of the EU Digital Services Act, except where doing so would compromise an investigation or endanger safety.

6. Appeals

If you believe an enforcement action was taken in error, you may appeal by contacting us at support@coloringmagic.art within thirty (30) days. We will review your appeal and respond within a reasonable timeframe. For further details, see the appeals provisions in our Content Policy.

7. Reporting Violations

If you become aware of any user violating this AUP, please report it by emailing support@coloringmagic.art or by following the process described in our Removal Requests page.

8. Changes to This Policy

We may update this Acceptable Use Policy from time to time. Material changes will be communicated by posting a notice on our website and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the revised policy.
