Content Policy

1. Introduction and Scope

Coloring Magic ("we," "us," or "the Service") is an online platform that lets users generate custom coloring-book pages using artificial intelligence. This Content Policy governs the types of content that may and may not be created, stored, or shared through the Service. It applies to all users regardless of location.

This policy is designed to comply with applicable laws and regulations across the jurisdictions in which we operate, including but not limited to the EU Digital Services Act (Regulation (EU) 2022/2065), the EU AI Act (Regulation (EU) 2024/1689), the Austrian E-Commerce Act (ECG), the UK Online Safety Act 2023, applicable United States federal and state laws, the Australian Online Safety Act 2021, and the laws of Switzerland, Norway, and other EEA member states.

This Content Policy supplements our Terms of Service, Acceptable Use Policy, and IP and Output Rights. In the event of a conflict, the more restrictive provision applies.

2. Guiding Principles

Coloring Magic produces printable coloring-book artwork intended for all ages, including children. Our guiding principles are:

  • Child safety first. We maintain a zero-tolerance stance toward any content that sexualises, exploits, or endangers minors.
  • Family-friendly outputs. Every generated image should be suitable for printing and colouring by users of the selected age group, from young children to adults.
  • Responsible AI use. All images are generated by AI models. We apply prompt-level filtering and model-level safety configurations to minimise the risk of harmful outputs.
  • Transparency. All outputs produced by the Service are AI-generated. We disclose this in accordance with Article 50 of the EU AI Act.

3. Prohibited Content

You may not use the Service to generate, attempt to generate, store, or distribute any of the following categories of content. These prohibitions apply to text prompts, generated images, and any other material submitted to or produced by the Service.

3a. Child Sexual Abuse Material (CSAM) and Content Exploiting Minors

Any content that depicts, suggests, or facilitates the sexual exploitation or abuse of minors is absolutely prohibited. This includes realistic and non-realistic depictions, AI-generated imagery, and any prompt designed to produce such material.

We are legally obligated to report confirmed or apparent CSAM to the relevant authorities, including the U.S. National Center for Missing & Exploited Children (NCMEC), the UK Internet Watch Foundation (IWF), and national law-enforcement agencies as applicable. Accounts involved in CSAM will be terminated immediately without prior notice, and all associated data will be preserved for law-enforcement purposes.

3b. Sexual and Sexually Suggestive Content

Sexually explicit content, pornography, and sexually suggestive imagery are not permitted. This includes nudity, depictions of sexual acts, and content designed to arouse. Because Coloring Magic is a family-oriented service, this restriction applies regardless of whether the depicted subjects are adults.

3c. Illegal Content

Content that is illegal under the laws of Austria, the European Union, or the jurisdiction of the user is prohibited. This includes, without limitation:

  • Imagery promoting or facilitating drug manufacturing, trafficking, or consumption of controlled substances.
  • Content that constitutes or facilitates fraud, counterfeiting, or forgery.
  • Material that violates export-control or sanctions regulations.
  • Content that incites or instructs criminal activity.

3d. Hate Speech, Discrimination, and Harassment

Content that promotes hatred, violence, or discrimination against individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic is prohibited. This includes symbols, slogans, and imagery associated with extremist or supremacist movements.

Content created with the intent to bully, intimidate, harass, or threaten a specific individual or group is likewise not allowed.

3e. Violence, Gore, and Graphic Content

Graphic depictions of violence, gore, mutilation, torture, or content primarily intended to shock or disturb are prohibited. This includes realistic depictions of weapons used in violent scenarios. Stylised or age-appropriate fantasy themes (e.g., knights, dragons) are generally permitted provided they do not depict gratuitous violence.

3f. Terrorism and Violent Extremism

Content that glorifies, recruits for, or provides operational support to terrorist organisations or violent extremist movements is prohibited. This includes propaganda, insignia, and imagery associated with designated terrorist groups under EU, UN, US, UK, or Australian sanctions lists.

3g. Self-Harm and Suicide

Content that promotes, glorifies, or provides instructions for self-harm or suicide is prohibited. This does not prevent the depiction of mental-health awareness themes when presented responsibly and without graphic detail.

3h. Trademarks, Logos, and Brand Identifiers

You may not generate images that reproduce or closely imitate third-party trademarks, logos, brand names, or other proprietary brand identifiers. For further details, see our IP and Output Rights policy.

3i. Real Individuals and Public Figures

Generating images intended to depict real, identifiable individuals — including celebrities, politicians, and other public figures — is not permitted. This restriction protects personality rights, rights of publicity, and helps prevent deepfake-style misuse. For further details, see our IP and Output Rights policy.

3j. Deceptive or Misleading Content

Content designed to deceive, defraud, or mislead others is prohibited. This includes imagery intended to impersonate real organisations, fabricate events, or spread disinformation.

3k. Privacy Violations and Personal Data

Content that exposes another person's private information — such as addresses, phone numbers, financial details, or identification documents — without their consent is prohibited. This includes prompts that contain personal data of third parties.

4. Content Moderation

We use a combination of automated and, where necessary, human moderation to enforce this policy:

  • Prompt filtering. User prompts are screened before being sent to the AI model. Prompts that match prohibited categories are blocked and the generation request is rejected.
  • Model-level safeguards. The underlying AI model is configured with safety settings that reduce the likelihood of producing prohibited content.
  • Post-generation review. We may apply additional automated checks on generated images. In certain cases, flagged content may be reviewed by a member of our team.
  • User reports. Any user or third party can report content that they believe violates this policy (see Section 5 below).

No automated system is perfect. If you encounter a generated output that appears to violate this policy, please report it so we can take appropriate action and improve our safeguards.

5. Reporting Violations

If you believe that content generated through our Service violates this policy, applicable law, or your rights, you may report it by:

In accordance with the EU Digital Services Act, we will acknowledge receipt of your report without undue delay and inform you of our decision in a timely, non-discriminatory manner. Reports involving imminent risk to safety or involving minors are prioritised.

Trusted flaggers, as defined under Article 22 of the DSA, may submit reports through the same channels and will receive priority processing.

6. Enforcement and Consequences

Violations of this Content Policy may result in one or more of the following actions, applied at our discretion and proportionate to the severity and frequency of the violation:

  • Warning. A written notice informing you of the violation and requesting compliance.
  • Content removal. Immediate removal or blocking of the offending content.
  • Temporary suspension. Temporary restriction of your ability to generate images or access certain features.
  • Account termination. Permanent closure of your account. Any remaining token balance may be forfeited if the termination results from a serious policy violation.
  • Law-enforcement referral. Where we are legally required or reasonably believe it is necessary, we will refer the matter to competent authorities. This includes mandatory reporting of CSAM to NCMEC (United States), the IWF (United Kingdom), the BPjM/BzKJ (Germany/Austria), or equivalent national bodies.

Where we restrict or remove content or suspend or terminate an account, we will provide you with a clear statement of reasons in accordance with Article 17 of the DSA, unless doing so would compromise an ongoing investigation or endanger the safety of any person.

7. Appeals

If you believe that an enforcement action was taken in error, you may appeal by contacting us at support@coloringmagic.art within 30 days of the action. Your appeal should include:

  • Your account email address.
  • A description of the enforcement action you are appealing.
  • The reason you believe the action was incorrect.

We will review your appeal and respond within a reasonable timeframe, typically no later than 30 days. In accordance with the DSA, you also have the right to refer complaints to an out-of-court dispute-settlement body certified in an EU member state, or to seek judicial redress before a competent court.

8. Jurisdiction-Specific Notes

European Union and European Economic Area

Our content-moderation practices are designed to comply with the Digital Services Act (Regulation (EU) 2022/2065) and the AI Act (Regulation (EU) 2024/1689). We maintain transparent reporting mechanisms, provide statements of reasons for content-moderation decisions, and offer an internal complaint-handling system as required by the DSA. All AI-generated outputs are disclosed as such in accordance with Article 50 of the AI Act.

Austria

As the operator is established in Austria, the Service complies with the Austrian E-Commerce Act (ECG) and the Austrian Consumer Protection Act (KSchG). Provider identification details are available on our Imprint page. Content that violates Austrian criminal law — including Section 207a of the Austrian Criminal Code (Pornographic Depictions of Minors) and Section 283 (Incitement to Hatred) — is strictly prohibited and will be reported to the Austrian Federal Criminal Police Office (Bundeskriminalamt) as required.

United Kingdom

We aim to comply with the duties of care established by the UK Online Safety Act 2023 with respect to illegal content and content harmful to children. CSAM is reported to the Internet Watch Foundation (IWF) and the National Crime Agency (NCA) as required by UK law.

United States

The Service is not directed at children under the age of 13. In the event that we become aware of a user under 13, we will take appropriate steps in accordance with the Children's Online Privacy Protection Act (COPPA). Confirmed or suspected CSAM is reported to NCMEC in accordance with 18 U.S.C. § 2258A. Nothing in this policy limits any protections or immunities available under Section 230 of the Communications Decency Act.

Australia

Content falling within Class 1 material (such as CSAM, content promoting terrorism, or content instructing in crime) under the Australian Classification scheme is prohibited and will be reported to the eSafety Commissioner. We cooperate with removal notices issued under the Online Safety Act 2021.

Switzerland and Norway

Switzerland maintains bilateral agreements with the EU that substantially align its digital regulatory framework. Norway, as an EEA member, is subject to the DSA and related EU regulations. Users in these jurisdictions are subject to the same content standards described in this policy.

9. Changes to This Policy

We may update this Content Policy from time to time to reflect changes in the law, our services, or our enforcement practices. Material changes will be communicated by posting a notice on our website and updating the "Last updated" date at the top of this page. Where required by law, we will provide advance notice before changes take effect. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised policy.
