Refund and Cancellation Policy

1. Overview

This policy explains how refunds, cancellations, and chargebacks are handled for purchases made on Coloring Magic ("we," "us," or "the Service"). The Service uses a token-based payment model: you purchase token packages for a one-time payment, and tokens are consumed when you generate images.

2. Token Purchases

Token packages are available for one-time purchase at the prices displayed on our pricing page [TOKEN_PACKAGES_PLACEHOLDER]. All prices are in United States Dollars (USD). Payments are processed securely by Stripe. There are no recurring subscriptions.

3. General Refund Policy

Because tokens are digital content delivered immediately upon purchase, token purchases are generally non-refundable. Once tokens are credited to your account, they are available for immediate use. Tokens cannot be converted back to cash, transferred to another user, or redeemed outside the Service.

4. EU/EEA Consumer Right of Withdrawal

If you are a consumer in the European Union or European Economic Area, you are normally entitled to a 14-day cooling-off period (right of withdrawal) for online purchases under Directive 2011/83/EU (Consumer Rights Directive) and the Austrian Consumer Protection Act (KSchG).

However, in accordance with Article 16(m) of the Consumer Rights Directive, you may lose this right of withdrawal for digital content that is not supplied on a tangible medium if:

  • You have given your prior express consent to begin the supply of the digital content immediately.
  • You have acknowledged that you thereby lose your right of withdrawal.

During the checkout process, you will be asked to confirm both of these conditions before your purchase is completed. Once you confirm and the tokens are delivered to your account, your right of withdrawal is waived.

If the checkout process does not include this explicit consent step, or if you have not yet used any of the purchased tokens, you may exercise your right of withdrawal within 14 days of purchase by contacting us at support@coloringmagic.art.

5. UK Consumer Rights

If you are a consumer in the United Kingdom, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 provide a similar 14-day cancellation right for digital content. As with EU consumers, this right may be waived if you give express consent to immediate delivery and acknowledge the loss of the cancellation right before purchase.

6. Exceptions — When We Will Issue a Refund

Notwithstanding the general non-refundable nature of token purchases, we will consider issuing a refund in the following circumstances:

  • Duplicate charges. If you are charged more than once for the same token package due to a payment processing error, we will refund the duplicate charge in full.
  • Failed image generation. If an image generation fails due to a technical error on our side, the tokens consumed for that attempt are automatically refunded to your account balance by our system. If automatic refund does not occur, please contact us.
  • Service outage. If a prolonged service outage prevents you from using tokens you have purchased, we may issue a refund or credit at our discretion.
  • Billing errors. If the amount charged does not match the price displayed at the time of purchase, we will refund the difference or issue a full refund.
  • Unauthorised transactions. If you believe a purchase was made without your authorisation, contact us immediately. We will investigate and, if confirmed, issue a refund.

7. How to Request a Refund

To request a refund, please email us at support@coloringmagic.art within thirty (30) days of the transaction. Include the following information:

  • Your account email address.
  • The date and amount of the transaction.
  • The reason for your refund request.
  • Any supporting evidence (e.g., duplicate charge receipt, screenshot of a failed generation).

We will review your request and respond within ten (10) business days. Approved refunds are processed through Stripe to the original payment method. Please allow 5–10 additional business days for the refund to appear on your statement, depending on your bank or card issuer.

8. Chargebacks

We encourage you to contact us directly before initiating a chargeback (payment dispute) with your bank or card issuer. Chargebacks generate processing fees and can delay resolution. If you contact us first, we can often resolve the issue faster and more favourably.

If a chargeback is filed, we will provide Stripe with relevant transaction documentation. Filing a chargeback that is later found to be unwarranted may result in the suspension or termination of your account.

9. Account Closure

You may close your account at any time by contacting us at support@coloringmagic.art. Account closure does not entitle you to a refund for unused tokens. Upon closure, your remaining token balance is forfeited.

If your account is terminated by us due to a violation of our Terms of Service or Content Policy, any remaining token balance may be forfeited.

10. Australian Consumer Guarantees

If you are a consumer in Australia, the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) provides consumer guarantees that cannot be excluded. If our digital products fail to meet a consumer guarantee, you may be entitled to a remedy (refund, replacement, or repair) depending on the nature of the failure. Nothing in this policy is intended to exclude, restrict, or modify any rights you have under the Australian Consumer Law.

11. Mandatory Consumer Protections

Nothing in this policy affects any mandatory consumer-protection rights that you may have under the laws of your jurisdiction that cannot be excluded or limited by contract. This includes, but is not limited to, rights under the Austrian Consumer Protection Act (KSchG), EU consumer law, the UK Consumer Rights Act 2015, and the Australian Consumer Law.

12. Changes to This Policy

We may update this policy from time to time. Material changes will be communicated by updating the "Last updated" date at the top of this page. Changes do not apply retroactively to purchases made before the change.
